As a result of changes made to the Electoral Act 1918 (Cth) in 2006, persons serving full-time prison sentences are prohibited from voting in federal elections. The constitutional validity of these amendments was recently challenged by Vickie Roach, a current inmate of a Victorian prison. The Full Bench of the High Court heard the case (Roach v Electoral Commissioner & Anor) on 12 and 13 June 2007 (judgment has not yet been delivered).

You are the Australian representative at an international conference on Prisoner Voting Rights in Toronto, Canada. You have been asked to prepare a paper about whether there is a “right to vote” in Australia, and the scope of any such right, focusing particularly on whether denying prisoners the right to vote can or cannot be justified under Australian law.......
